These Terms of Use (“Terms”) govern your access to and use of nipperconstruction.com (the “Site”), operated by Nipper Construction Group (“Nipper Construction,” “we,” “us,” or “our”). By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, please do not use the Site.


1. Use of the Site

The Site and its content are provided for general informational purposes about our construction services, projects, and company. You may use the Site only for lawful purposes and in accordance with these Terms. You agree not to:

  • Use the Site in any way that violates applicable local, state, national, or international law;

  • Submit false, misleading, or fraudulent information through any form on the Site;

  • Upload documents that are falsified, expired, or do not accurately represent your or your company’s insurance or qualifications;

  • Attempt to interfere with, disrupt, or gain unauthorized access to the Site, its servers, or any connected network;

  • Use any automated means (bots, scrapers, etc.) to access the Site for purposes other than standard search engine indexing; or

  • Upload or transmit viruses, malware, or other harmful code through any form on the Site.

2. Intellectual Property

All content on the Site, including text, graphics, logos, images, project photography, and the design and arrangement of the Site, is owned by or licensed to Nipper Construction and is protected by copyright, trademark, and other intellectual property laws. You may view and print pages of the Site for your own personal, non-commercial reference, but you may not reproduce, distribute, modify, or create derivative works from any part of the Site without our prior written consent.

3. Services, Bids, and Project Information

Information about our construction services, project capabilities, and areas of operation on the Site is provided for general informational purposes only and does not constitute a bid, proposal, contract offer, or guarantee of project availability. All project bids, proposals, subcontracting arrangements, and agreements must be confirmed in writing by an authorized representative of Nipper Construction before they are binding. Inclusion on our pre-qualified subcontractor list does not guarantee the award of any project or subcontract.

4. Forms and User Submissions

4.1 Contact Form

When you submit our contact form, you represent that the information you provide is accurate and that you have the right to submit it. We may use this information to respond to your inquiry as described in our Privacy Policy.

4.2 Careers / Employment Application Form

Our careers form allows you to submit personal and professional information, including a resume or supporting file. By submitting an application, you represent that all information and any uploaded file are accurate and that you own or have the right to submit them. Submission of an application does not guarantee an interview, offer, or employment. Nipper Construction is an equal opportunity employer and considers all applicants without regard to any status protected by applicable law.

4.3 Subcontractor Pre-Screening / Bid Qualification Form

Our pre-screening form allows businesses to submit company information and upload a Certificate of Insurance or other required documentation in connection with eligibility to receive bid invitations from Nipper Construction. By submitting this form, you represent that:

  • You are authorized to submit the form on behalf of your business;
  • All information provided is accurate and current;
  • Any Certificate of Insurance or other document uploaded is valid, unexpired, and accurately represents your company’s insurance coverage and qualifications.

Submission of the pre-screening form does not constitute a binding agreement, guarantee of bid invitation, or guarantee of subcontract award. Nipper Construction reserves the right to accept or reject any submission at its sole discretion.

4.4 General

You are solely responsible for any content you submit through the Site’s forms, including all uploaded files. We reserve the right, but have no obligation, to monitor, remove, or refuse any submission at our discretion.

5. Third-Party Services and Links

The Site uses Google Analytics and Google reCAPTCHA. Your use of the Site’s forms is subject to the Google Privacy Policy and Google Terms of Service. The Site may also link to other third-party websites that are not owned or controlled by us. We are not responsible for the content, accuracy, or practices of any third-party site, and inclusion of a link does not imply our endorsement.

6. Disclaimer of Warranties

THE SITE AND ITS CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

7. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, NIPPER CONSTRUCTION AND ITS OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR DATA, ARISING FROM OR RELATED TO YOUR USE OF THE SITE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM YOUR USE OF THE SITE SHALL NOT EXCEED ONE HUNDRED DOLLARS ($100).

8. Indemnification

You agree to indemnify and hold harmless Nipper Construction and its officers, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising out of your use of the Site, your violation of these Terms, your submission of any content or documents through the Site, or any misrepresentation in a Certificate of Insurance or other document you upload.

9. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of North Carolina, without regard to its conflict of laws principles. You agree that any dispute arising from these Terms or your use of the Site shall be subject to the exclusive jurisdiction of the state or federal courts located in North Carolina.

10. Changes to These Terms

We may revise these Terms at any time by updating this page. Changes are effective immediately upon posting. Your continued use of the Site after changes are posted constitutes your acceptance of the revised Terms.

11. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
